Sheds & Outbuildings

City ordinances regulate the installation and maintenance of sheds and similar outbuildings. Additional regulations appear in the Neighborhood Conservation District design standards and the Community Covenant deed restrictions which typically take precedent over city ordinances. When in doubt, consult city staff and also WOHA.

  • Permits. Permits may be required for some types of new outbuilding construction and remodeling, particularly if plumbing or electrical modifications will be made. Most permits are inexpensive and can be obtained from CoSA at 1901 South Alamo St.

  • Temporary versus Permanent. NCD standards prohibit temporary outbuildings (defined as those without a permanent foundation such as slab, piers, piles, posts) visible from the street. This includes tents, greenhouses, shade structures, removable carports, and portable tool sheds. Permanent outbuildings are subject to limitations including those herein.

  • Occupancy. Usage of outbuildings for purposes such as a home office or hobby workshop is prohibited. Community Covenants prohibit residency of any type of outbuilding for any length of time.

  • Material. Consult CoSA staff regarding UDC building requirements.

  • Height. Consult CoSA staff regarding UDC building requirements.

  • Placement / Setback. Most outbuildings shall be set back at least 3 ft from a rear or side property line. Those which architectural features such as eaves shall be set back at least 5 ft.

  • Footprint. The total square footage of any outbuilding may not exceed 25% of the primary dwelling. Additionally, for most properties, the combined square footage of all outbuildings may not exceed 50% of the rear and side yard total area.

  • Grading / Drainage. Modification of soil for installation of an outbuilding must not unreasonably redirect rainfall into a neighboring property.

  • Maintenance. Outbuildings shall be structurally sound and maintained in good repair to not create blight or nuisance. Rotted, damaged, or missing components shall be replaced. Faded or peeling paint shall be repaired. Vermin shall be eradicated.

  • Exceptions. Permanent carports and garages are not considered outbuildings; other regulations apply.

Installation and maintenance of residential fencing within Whispering Oaks is regulated by city ordinances, including the Neighborhood Conservation District standards, and also the Community Covenant deed restrictions which typically take precedent. When in doubt, consult city staff and also WOHA.

  • Permits. All new fencing or repair / replacement of more than 25% linear footage of existing fencing must obtain a permit prior to installation. Permits are inexpensive and can be obtained online from CoSA.

  • Material. Wood, masonry and some forms of metal including wrought iron are allowed. City ordinances prohibit use of barbed wire, plywood, tarps, metal paneling or materials not manufactured as fencing. NCD standards prohibit chain link within Whispering Oaks.

  • Height. Most sections shall have a maximum height of 6 ft in height. Sections surrounding swimming pools, abutting alleyways and select high-traffic roadways are allowed a maximum height of 8 ft. Some sloped lots or those abutting public and commercial facilities may also qualify for 8 ft height. Height is determined from the lowest ground point to the top of the fence.

  • Placement. Community Covenants specify that fencing may not extend beyond the dwelling’s façade for most properties. Architectural masonry fencing integrated into the dwelling is considered part of the façade.

  • Maintenance. Fences shall be maintained in good repair and not create blight or nuisance. Rotted, damaged, or missing components shall be replaced. Fences may not lean in excess of 15 degrees.

  • Safety. Most swimming pools and spas must be completely surrounded by a safety fence of at least 48” height and include a lockable or self-latching gate.

  • Motorist Visibility. Fencing over 3 ft height may not be installed on a corner lot within 25 ft from the intersection or within 15 ft of a driveway or alleyway entrance.

  • Exceptions. Panel blinds intended to conceal waste receptacles, retaining walls, and short garden borders are not considered fencing.
